We Respect Your Personal Information

Wicked Fashions, Inc. (“WFI”) understands that you are concerned about how we handle information that we may collect about you through our online services. We have implemented this Privacy Policy because we are committed to responsibly managing your personal information.

We encourage you to read our Privacy Policy before providing any personal information to us so you can learn how we collect, use and share that information and about the choices you have to access and manage this information.

Scope of Policy

This Privacy Policy applies only to personal information that identifies you (“Personal Information”) collected by the online services maintained by WFI, including websites, mobile applications and other online services where this Privacy Policy is posted (“WFI Online Services”).

There are exceptions, however, and the Privacy Policy does not cover the following personal information about you:

  • Personal Information submitted to us in a business capacity, including personal information such as your date of birth, social security number, contact information, employment and other information submitted to us on-line by job applicants, and by persons specifying that they are submitting personal information in a business capacity (such as employees of retailers submitting information to access our line sheets). Information gathered in this context will be used solely for its intended purpose;
  • Personal Information collected by online services that we don’t own or control that may operate on or link to WFI’s Online Services, such as third party social media sites like FACEBOOK®. (please refer to the privacy policies of these other services and be aware that their policies may differ from WFI’s);
  • Personal Information contained in any comments, photographs and other user-generated content that you chose to share in any areas of WFI’s Online Services that can be viewed by the public; and
  • Personal Information collected by WFI offline.
Your Use of Our Website Is Consent

By using WFI’s Online Services, you hereby consent to the collection, use, management, retention and disclosure of your Personal Information by WFI as described in this notice. If you disagree with any part of this Privacy Policy, then please do not use any WFI Online Service.

Occasionally, we may revise and update this Privacy Policy. Your continued use of the WFI Online Services after we publish our changes indicates your acceptance of any changed terms. Special Notice to Foreign Users WFI controls and operates its business and online services from within the United States of America. Our online privacy practices may differ from privacy laws in your home country. 2. Information We May Collect About You



Personal Information that you provide to us
From time to time the WFI Online Services may have features that ask you to provide Personal Information through the WFI Online Services. For instance, when you register to receive news from us, should we offer that feature, or when you participate in contests that we may run, we may collect Personal Information that you provide to us. The data we collect depends on the services and features you use, and may include the following:
  • Name and contact information, including your email address, mailing address, city and state, zip code and phone number(s);
  • Date of birth;
  • Image, likeness and voice (such as in a photograph or video);
  • User name and password;
  • Your screen name;
  • Additional Personal Information that may be necessary to administer certain promotional events; and
  • Geo location information (if you are using a mobile device).
Automatically Collected Data Elements that are Not Personal Information
The WFI Online Services also collect anonymous information indirectly through technology such as cookies and web beacons to help us better understand user behavior, tell us which parts of our websites people have visited, help us measure the effectiveness of our advertising efforts, and help us administer certain features of our Online Services.
Some of the data elements and other types of non-personal information about you (“Non-Personal Information”) that we may automatically collect includes the following:
  • Your computer’s IP address, which is a unique number assigned to your computer to identify it when you are using your computer on the internet;
  • Information collected through cookies, pixel tags and other technologies described in more detail later in this Privacy Policy;

  • Mobile application usage data;
  • Aggregated “click stream” information such as entry and exit points for the WFI Online Services (including referring URLs or domains), pages that are visited, certain WFI Online Services traffic statistics, page views, and impressions; and
  • Other types of non-personal information (known as demographic information) such as your age, gender, dates of birth, hobbies, and product preferences.

3. Our Use and Sharing Of Your Personal Information



How We May Use Your Personal Information
We may use Personal Information about you for purposes described in this Privacy Policy or as otherwise disclosed to you through the WFI Online Services. For example, we may use your Personal Information as follows:
• To provide you with emails, newsletters, and other mailings about our products and promotions and to help us learn about your preferences;
• To determine your eligibility for certain contests or features and to fulfill contests;

Other than “transactional or relationship” communications, we will not use Personal Information we collected from you to send you emails, text or other communications unless you register with us on the WFI Online Service. We generally consider “transactional or relationship” communications to include communications that facilitate an already agreed upon transaction, such as responding to an email request you made of us, or to a request to change your password or to manage your account.
How we May Share Your Personal Information
We don't sell or rent your Personal Information to third parties without your prior consent. However, we may share such information in the following ways:
• To third-party service providers who help develop, provide and improve the WFI Online Services, such as website hosting, website administration, website design, and information technology, or who provide customer service, e-mail delivery, marketing communications, prize fulfillment, auditing and other services;
• To perform services you request or functions you initiate, such as when you post information and materials on message boards and forums (please keep in mind that when you post information in a public forum it becomes public information);
• To identify you to anyone to whom you send communications through the WFI Online Services, should we offer such a feature;
• To companies that are under common control with WFI (our “Affiliates”) for the purposes described in this Privacy Policy;
• In connection with a corporate reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets, stock or other equity interests, including in connection with any bankruptcy or similar proceedings. In the event of such a transaction, your Personal Information may be transferred to our successor or assign as part of the transferred assets; and
• As we deem necessary or appropriate: under applicable law; to a court order, subpoena, law enforcement proceeding, regulatory inquiry or when otherwise legally required; to pursue available remedies or limit damages we may sustain; to protect our Online Services or operations or those of any of our Affiliates; to protect the rights, privacy, safety or property of WFI or our Affiliates, you and others; and to enforce our Terms and Conditions.

4. Our Use and Sharing of Your Non-Personal Information



“Non-Personal Information” that we collect is information that we collect indirectly through technology that does not personally identify you.
We may use this Non-Personal Information in order to administer the WFI Online Services and to determine how to improve the WFI Online Services such as by seeing which areas, features, and products are most popular; by personalizing the WFI Online Services; by using it to troubleshoot problems, and by completing transactions you have requested. While some of this data may be traceable to an individual, we only seek to identify individuals whom we believe are using our website for improper purposes.
Non-Personal Information is not treated as Personal Information covered by this Privacy Policy, and it may be disclosed and otherwise used for any purpose not prohibited by law. If Non-Personal Information is combined with Personal Information in a way that can identify you or be used to identify you personally, it is treated as Personal Information and is subject to this Privacy Policy.

5. Social Networking And Third Party Sites



When you link to the WFI Online Services through any social networking or third party site, application or service, or if you leave the WFI Online Services through a link on a WFI Online Service to any social networking or third party site, application or service, please remember that you are bound by the privacy policy of the social network or third-party site, application or service. We do not control, and are not responsible for, the privacy practices of such sites, and you should consult the privacy policy of such sites to determine the information practices of those sites. We advise you to read the privacy policy of such site, application or service before providing any of your Personal Information to the host.

6. Security



We have implemented reasonable security measures to protect your Personal Information from unauthorized access and improper use. Some of the measures that we have implemented include establishing policies and procedures for securely managing Personal Information; requiring service providers with whom we do business to comply with our Privacy Policy and relevant data privacy legal and regulatory requirements or to have practices that meet our Privacy Policy requirements; and providing data privacy training to our team members.

From time to time we may collect personally identifiable information about your activities over time and across certain third-party websites or online services in order to measure and improve the effectiveness of our marketing efforts and to deliver targeted ads to you based on your online activities. 8. Cookies, Web Beacons and Certain Other Technology



We use cookies on our websites. Cookies are small text files that a website places on your hard drive to identify your computer whenever you visit the website. Cookies may be linked to Personal Information about you. We may from time to time use third party advertising companies to place WFI advertisements both on and outside of the WFI Online Services. This section provides additional information about the collection and use of information from or about you in connection with such advertising. 10. Your California Privacy Rights



California Third Party Direct Marketing Notice Since 2005, California Civil Code Section 1798.83 permits our users who are California residents to request certain information with respect to the types of personal information WFI has shared with third parties for their direct marketing purposes, and the identities of those third parties, within the immediately preceding calendar year, subject to certain exceptions. 12. Personal Information and Children



We do not knowingly collect personal information directly from any person under the age of 13. WFI’s Online Services are not intended to be directed towards individuals under the age of 13, and if we have actual notice that a child under age 13 has provided us with personal information, then we will we will take reasonable measures to delete such information.
